ASCEND Bot - Terms of Service Agreement

This Terms of Service Agreement (the "Agreement") is entered into between the owners of the ASCEND bot, @stevented and @untanukii ("Bot Owners"), and the user ("User") of the ASCEND bot on Discord (the "Bot").

By using the Bot, the User agrees to be bound by the terms of this Agreement. If the User does not agree to these terms, they must immediately stop using the Bot.

1. Use of the Bot

The Bot Owners grant the User a non-exclusive, non-transferable, and limited license to use the Bot. The User acknowledges that the Bot is intended for use within a Discord server, and its usage is governed by the terms outlined in this Agreement.

2. Prohibited Use

The User agrees not to use the Bot for any illegal or unauthorized activities, including but not limited to:

  • Violating any laws, regulations, or Discord’s Terms of Service.

  • Abusing or exploiting the Bot’s features (e.g., artificially inflating RP or exploiting the streak system).

  • Using the Bot for commercial purposes without explicit written consent from the Bot Owners.

  • Sending spam or engaging in disruptive behavior within the server or through the Bot.

3. Limitation of Liability

The Bot Owners shall not be held liable for any damages resulting from the use, misuse, or inability to use the Bot, including but not limited to data loss, RP loss, server issues, or any other harm to the User or their Discord account. The User agrees to use the Bot at their own risk.

4. Bot Modifications

The Bot Owners reserve the right to modify, suspend, or discontinue the Bot at any time without prior notice. The User agrees that the Bot Owners shall not be liable to the User or any third party for any modifications, suspension, or termination of the Bot.

5. Intellectual Property

All intellectual property rights related to the Bot, including its code, design, and features, remain the property of the Bot Owners. The User agrees not to copy, modify, distribute, or reverse-engineer the Bot, in whole or in part, without explicit written consent from the Bot Owners.

6. Indemnification

The User agrees to indemnify and hold harmless the Bot Owners, their affiliates, directors, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses, including reasonable attorney fees, arising from the User’s use of the Bot, including any violations of this Agreement.

7. Termination

This Agreement may be terminated by either party at any time and for any reason. Upon termination, the User must immediately cease all use of the Bot. The Bot Owners may suspend or permanently terminate the User’s access to the Bot in the event of a violation of this Agreement.

8. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of France. Any disputes arising from or related to this Agreement shall be resolved through arbitration or any other dispute resolution method deemed appropriate by the Bot Owners.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes any prior or contemporaneous agreements, representations, or understandings, whether written or oral, relating to the use of the Bot. Any modifications to this Agreement will be communicated to the User, and continued use of the Bot constitutes acceptance of such modifications.

By using the ASCEND bot, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not accept any part of these terms, you must immediately stop using the Bot.
